Emergency Powers May Be Extended Again In July


As the end of the pandemic has arrived, Governor Walz has shown severe reluctance to give up his emergency powers. In a move that surprised many, he re-upped his peacetime emergency on June 14th for another 30 days. Some spectators believe that Walz could extend his powers again in July.

 

Republicans in the state legislature have made it clear that they want to do away with this peacetime emergency that has ravaged the state for the last 15 months, but it is not clear what actions they are taking to make that happen. Some legislators have introduced weak reform bills that would inconvenience Walz at best and empower unelected bureaucrats at worst

 

Tyrant Tim Walz has grown comfortable with his ability to create law. As the legislature shows no real threat to his power, he will continue to write executive orders that are enforced like law for as long as he wants. There is, however, something that legislators can do to stop him.

 

Because the state budget is being negotiated as we speak, all legislative leaders -- including Walz -- are sitting down at the bargaining table. If Senate Majority Leader Paul Gazelka makes clear that there will be no deals on the budget until Walz signs a bill to end his powers, the legislature can earn back their designation as a co-equal branch of government. 

 

The bill that he needs to push is SF2356, otherwise known as the Never Again bill. Originally introduced in the house by Representative Erik Mortensen, the Never Again bill seeks to strip the governor of their ability to unilaterally declare an executive emergency… The ONLY proposal that goes this far.

 

Tell your State Senator to pass SF2356 and to hold up budget negotiations until this thing gets done.

Legislators Hope To Shirk Deadline And Put State Budget On AutoPilot With No End Powers Bill


Governor Walz called a special legislative session on Monday for two reasons. The first of which was because he extended his emergency powers for another 30 days, and he is legally required to give the legislature a chance to revoke those powers. The second reason was to allow the legislature to negotiate a budget for the upcoming biennium.

 

If the Republican Senate and the DFL House cannot agree on a budget by July 1st, the State Government will shut down. However, in an effort to avoid backlash from his constituents, Senate Majority Leader Paul Gazelka is looking to eradicate the July 1st deadline.

 

In his bill introduced on Monday, Gazelka proposes that the state government continue to operate regardless of whether or not legislators come to an agreement before July 1st. This bill is bad for a variety of reasons.

 

  1. By eliminating the July 1st deadline, legislators can go to St. Paul and collect their per diem for as long as they like! If the state government can fund itself, there is no need to actually get a budget done.
  2. By introducing this bill, Paul Gazelka and the Republican Senate Majority are forfeiting their seat at the bargaining table. If there is no pressure to meet a legislative deadline, then the DFL House and DFL Governor can steamroll Paul Gazelka into submission. That July 1st deadline is the one thing that forces Governor Walz and Speaker Hortman to listen to Gazelka. 
  3. This “de facto budget” will not include any kind of proposal to eradicate Governor Walz’ emergency powers -- something that Senator Gazelka claims to care about. 

 

If legislators put the state budget on “autopilot”, then they are further forfeiting their ability to legislate to bureaucrats and Governor Walz -- who already have too much power.

 

If Gazelka truly does care about Walz’ far-reaching emergency powers, then he would pass HF2204 (SF 2356 in the Senate) to eliminate Governor Walz’ power to unilaterally declare an emergency.

Never Again Protest Rocks The State Capitol


Protestors made a lot of noise yesterday at the Minnesota State Capitol. At 10:30 on Monday morning, activists from all across the state made their way to St. Paul to show their support for Representative Erik Mortensen’s Never Again bill

At the special session, legislators have the chance to completely revoke the governor’s ability to unilaterally declare an executive emergency, and Mortensen’s bill does exactly that.

Activists showed Senate Majority Leader Paul Gazelka that Mortensen’s bill needs to be passed into law before anything else -- it’s that important. As you can see from the pictures above, the protest spoke volumes about the massive support that this bill has.

New House Republican Caucus Introduces Fake End Gov Emergency Powers Bill - North Star Liberty Alliance


The New House Republican Caucus (NHRC) is trying to cheat by copying Representative Erik Mortensen’s (Mort’s) homework. Somehow, when they turned it in, Mort got an A+, while the NHRC got an F.

 

Just today, Representative Cal Bahr introduced a fake end emergency powers reform bill, which is cosponsored by Representatives Lucero, Mekeland, Drazkowski, Munson, and Miller. Looking to confuse their conservative constituents, they titled HF28  the “Never Again Bill”, which carries the same name as Mortensen’s superior legislation to try to dupe their constituents.

 

Not only is action petty, but it endangers the chances of serious legislation being passed. Mortensen’s bill has gathered serious support from across the state and is already being carried in the State Senate by Senator Mark Koran.

 

Legislators like Bahr, Lucero, Mekeland, Drazkowski, Munson, and Miller introduce bad legislation that runs cover for their swampy establishment pals, but seemingly don't care about actually stopping tyranny in the governor's mansion!

 

Walz is getting away with his crimes and only plotting more. He has only been allowed to get away with shutting down the state economy, keeping children out of school, putting COVID-positive patients in nursing homes, and much more because “conservatives” in the legislature care more about appearances than they do about principles.

Why has Governor Walz gotten away with making his own laws?

 

The controversies surrounding Governor Walz’ ability to issue edicts that carry the full force of law come from a state statute known as Minnesota Statute Chapter 12, which deals with emergency management. As of writing, there are two types of emergency declarations (§ 12.31)  available to the governor:

 

  • National Security: federal government indicates the imminence of a national security emergency or major Minnesota disaster rom enemy sabotage or other hostile action

 

  • Peacetime: an act of nature, a technological failure or malfunction, a terrorist incident, an industrial accident, a hazardous materials accident, or a civil disturbance endangers life and property and local government resources are inadequate to handle the situation.

 

 

Governor Walz has utilized and repeatedly extended the latter provision. His actions have become extremely controversial notably because there is no provision for a public health emergency. Undeterred, Walz has re-upped his emergency powers every 30 days for more than 15 months. The powers granted to the governor under this vague criteria include:

 

Subdiv. 1:  General direction and control of emergency management; allows the governor to exercise the following actions.

Subdiv. 2: Allows the governor to cooperate with the federal government, other states, Canadian provinces, and private agencies.

Subdiv. 3: Governor can make, amend, and rescind orders to carry out provisions in this chapter.

 

If the New House Republican Caucus had their way, they would fortify the ability for the governor to utilize these sweeping powers by creating a “Public Health Emergency” declaration under § 12.31.

 

New House Proposal Legitimizes Walz’ Tyranny

 

Bahr's bill reintroduces key provisions from a since modified 2002 law, which vastly expanded the governor’s authority in a “public health emergency”. The Minnesota Health Emergency Powers Act allowed the governor to act like a tyrant when he or she deemed fit. Specifically, this law allowed the governor:

  1. To issue edicts that carry the full force and rule of law
  2. Have full control over building occupancy
  3. Have full control over public and private transportation
  4. Commandeer private property
  5. Limit or eliminate funerals and visitations

 

This law is where Governor Walz derives much of his modern day power -- despite its questionable standing with the Minnesota Constitution. Representative Duke Powell made many modifications to this law when he introduced HF1555. His proposal kept some of the worst provisions that Walz has taken advantage of, though it was a slight improvement over the 2002 law. More specifically, this new law:

  1. Elimited allowance of “public health emergency” declarations
  2. Expands legislature’s ability to end a declared peacetime emergency
  3. Expands governor’s ability to issue rules and orders during any peacetime emergency

 

You see, the governor has not had the ability to declare a peacetime emergency in the name of public health since former Representative Duke Powell passed his bill eliminating its definition. If the NHRC successfully reintroduces a public health emergency declaration under chapter 12, Walz would be free to continue on his executive tirade against the liberties of Minnesotans.

 

New House Joins Many Other Bad Attempts To Reform Ch 12

 

In March of 2020, Many Republicans in the State Legislature backed Governor Walz’ use of emergency powers. It was only when groups like North Star Liberty Alliance began to raise this issue that legislators took notice and got to work on ending Walz’ executive emergency. Unsurprisingly, many of these proposals were all bark and no bite.

 

Weak attempts to end Walz’ tyranny included Representative Kurt Daudt’s MG022, which left the overwhelming majority of the governor’s power to declare sweeping emergencies intact. Another weak proposal from Representative Dave Baker sought to create a timeline of winding down some of Walz’ impact upon private businesses. His bill -- HF1336 -- would have still had tight restrictions on businesses even as the worst of the pandemic was over.

 

Believe it or not, The New House Republican Faker’s bad attempt at reforming Walz’ emergency powers actually includes some of the same provisions as a bill introduced by DFL Representative Julie Sansteade. Her bill -- HF1515 -- also makes an effort to legitimize Walz’ emergency powers by putting a definition of “public health emergency” into state law. In fact, this DFL bill uses the same exact definition of public health emergency that the NHRC’s does!

Supposed “conservatives” in the state legislature tout their efforts as their best bet at holding Governor Walz accountable. If the New House Republican Caucus believes that holding Walz accountable means taking the best from Mortensen’s bill, and the worst from Sandstede’s bill, conservatives across the state are in trouble. 

 

Mortensen’s Never Again bill takes aim at the governor’s ability to declare an executive emergency. If passed, the governor would have absolutely no emergency powers until approved by a 2/3rds majority in the House and the Senate. If the governor abuses their powers, they can be thrown in jail and fined. This proposal would also create a citizen’s bill of rights that ensures and protects the individual liberties of Minnesotans. 

 

Mortensen’s bill is the only true piece of legislation that ensures the detrimental lockdowns of 2020 never happen again.

 

In fact, it appears that the New House Republican Fakers agreed! Or at least, they agreed at one point…

 

 

As of writing, Jeremy Munson, Tim Miller, and Steve Drazkowski are all cosponsors on Representative Mortensen’s Never Again Bill! 

 

If they agreed with Mort when he first introduced his Never Again bill, then what changed? Sadly, it seems that the RINO leadership in the State House has gotten to the New House Republican Fakers. When you dive into the specifics of their brand new phony “Never Again” bill, it appears to carry some of the same nothingness that the plethora of other bad proposals do.

According to Hindustan Times, the Pakistani provincial government of Punjab will be blocking the SIM cards of citizens who failed to show up for their second dose of the COVID-19 vaccine. Despite decreasing coronavirus cases in the province, the government will not rest until any and all citizens are inoculated.

 

If the citizens of the United States do not remain vigilant, the same thing could happen here. Concerts and sporting events across the nation have already begun mandating proof of vaccination before admittance. How long before your business down the street demands that you disclose your private health history?

 

Luckily, some states like Florida have gotten ahead of this and banned vaccine passports. Unfortunately, others like New York and Hawaii have implemented passports statewide. Minnesota has neither enacted nor banned these “Licenses to Live”, and that could change soon.

 

Remember when the Minnesota Department of Health teased the possibility of COVID-19 vaccine passports? How about when Governor Walz began bribing citizens with their own tax dollars into getting the vaccine?

Walz And Legislators Looking To Squander $3.3 Billion Surplus


Governor Walz announced on Thursday that the budget surplus has grown from $1.6 Billion to $3.3 Billion. Despite Governor Walz’ best efforts to destroy the state economy -- much of which will never recover -- it appears that the state is still gathering impressive tax revenue.

 

After Walz and his pals in the legislature tossed the state into economic turmoil by shutting down businesses and restricting travel, their best course of action would be to return tax dollars to a vastly over-taxed citizenry. This would only be a tiny step towards correcting the damage from the past year.

 

Sadly, it appears that Walz and other greedy politicians are standing ready to spend it. In his Thursday press conference, Walz was proud to say that "[the surplus] gives us the opportunity, looking to the future, to make those investments that are important for our future".

 

In the wacky world of politics, “investment” often means big budget pet projects. A true waste of taxpayer dollars. With a budget due by July 1st, legislators have ample opportunities to sneak whatever they want into huge budget omnibus bills.

Walz Says He’ll Extend Emergency Powers For 15th Month


Tyrant Tim Walz has clung on to his detrimental and illegal executive powers for more than 554 days. Though many would come to believe that the “emergency” declared by Walz should be coming to an end, they would be wrong.

 

Governor Walz is officially extending his emergency powers for another 30 days, despite the apparent lack of an emergency. It’s becoming more and more obvious that Walz is positioning himself to be both a legislator AND a governor for the remainder of his term. Clearly, Walz has no respect for the separation of powers enshrined into the Minnesota State Constitution:

 

 

According to a reader’s poll by the Morning Take, 61.5% of its readers believe that Governor Walz’ emergency powers should come to an end. If Walz is such a pro-democracy guy, then surely he would want to listen to what the people have to say!

 

Unfortunately, the people’s wishes conflict with his grab for power. Walz will never voluntarily give up his emergency powers, so it’s time for the legislature to step up and do their job. With the June 14th special session fast approaching, legislators need to hear from you!

 

Michele Even, a pro-liberty activist, has organized a protest at the Minnesota State Senate Office Building, demanding that Senate Majority Leader Paul Gazelka take a stand against Walz and end his emergency once and for all. Gazelka can hold up budget negotiations until Governor Walz signs the “Never Again” bill -- the only true reform bill to stop abuse of executive powers.

 

Though the establishment is pushing a fake bill to reform the governor’s powers, it has nowhere near the support that the “Never Again” bill has. The protest on Monday will prove that much.

Grassroots patriots from all across the state will be gathering together on Monday, June 14th to protest the lack of action surrounding Representative Mortensen’s “Never Again” bill. The bill -- HF2204 -- would end Tyrant Tim Walz’ current “emergency” and drastically overhaul the governor’s ability to unilaterally declare an executive emergency.

If the Fake Reform Bill being pushed by the “conservative” establishment is passed, it would give Health Commissioner Jan Malcolm the ability to declare an executive emergency! That’s right, Minnesota’s very own Dr. Fauci would be able to take away your freedoms and liberties!

Why Omnibus Bills Are So Bad


Every other year, the Minnesota Legislature gets together and crafts enormous omnibus bills to keep the state government running. An omnibus proposal is a giant bill, with countless smaller bills wrapped up in it.

 

These bills range in subjects, but often include billions in new spending. What makes matters worse is that these bills can be thousands of pages long, making it difficult for legislators to understand every provision of the bill in the limited time that they have to read.

 

All those issues aside, it’s clear that the legislative tendency to pass sweeping omnibus bills is unconstitutional. The Single Subject and Title Clause can be sound in Article IV, section 17 of the Minnesota Constitution. This clause states that:

 

“No law shall embrace more than one subject, which shall be expressed in its title.”

 

According to MN House Research, delegates to the 1857 Minnesota Constitutional Convention were concerned about the practice of logrolling, or adding an unpopular provision to a popular bill, so that the unpopular provision can become law. No matter what the courts say about modern day omnibus bills, they clearly go against the intentions of the Minnesota Framers.

 

The modern day legislature walks a thin line with their omnibus bills, as they will embrace very general subjects such as “Education” or “Taxes”. Within these categories can be untold numbers of legislative proposals that lawmakers felt uncomfortable passing on their own.

 

Controversial proposals like vaccine passports could easily be snuck into these bills while nobody is looking. Because these bills are ultimately drafted days (and sometimes hours!) before a floor vote, legislators don’t get a real chance to read them! More importantly, the people of Minnesota don’t get to read them until it’s too late.

 

Because budget negotiations always come at the end of the legislative session, lawmakers become tired and lazy. They get to a point where they will vote for anything as long as they get to go home on time! Unless more Liberty-Champions like Erik Mortensen join the legislature, this kind of behavior is likely to continue.

Legislators' Final Chance To Pass “Never Again” Bill


Governor Walz is set to call the legislature into a special session this coming Monday, June 14th. Walz will use this opportunity to extend his emergency powers and give the legislature time to pass their enormous budget bills. Though this session is only a week away, it appears that legislative leaders still have not come to a deal.

 

Because Minnesota has a divided government, putting together a budget deal to keep the government running can be tricky. If the Republican Senate Majority is as eager as they claim to hold Walz accountable, they should immediately create a list of demands that includes the “Never Again” bill.

 

Representative Erik Mortensen’s “Never Again” bill -- HF2204 -- is the best proposal on the table for reforming the governor’s powers. Below are the provisions of Mortensen’s legislative proposal:

Now that the DFL needs the Republican Senate to accomplish aspects of their agenda, they have a prime opportunity to stop Tyrant Tim Walz in his tracks and take away his ability to unilaterally declare executive emergencies.

 

Mortensen’s bill is leaps and bounds better than Representative Barb Haley’s HF2640, which gives the ability to declare executive emergencies to the Minnesota Department of Health Commissioner, Jan Malcolm. Don’t take my word for it, read more about the garbage proposal here.

 

Republicans will initiate a half-hearted effort to pass Haley’s bad bill over Mortensen’s, and then inevitably cave to DFL demands and say that they tried their best. They have already admitted that they will not push for what they believe in! According to Senate Majority Leader Paul Gazelka, there is nothing worth shutting down the state government over:

 

“The Senate has no issues that we would demand a shutdown to get.”

 

Clearly your “conservative” legislators are ignoring the cries of the people. If you want to see Representative Mortensen’s “Never Again” bill turned into law, then tell your legislators that they need to stand up against establishment whims!
